Number of Senate cosponsors are 23 now. Since the original summons to action, at the above article, the number of Senate cosponsors has increased from 22 to 23. This is on February 5, 2010. |

Vote Constitutionally It is about time that we require our leaders to know and vote in accordance with our constitution. If they cannot do that, they should not be representing us. |

davethedefender It is simply amazing that we have to introduce bills into the U.S. Congress to make them adhere to the "Law of the Land," the United States Constitution. They have already taken an oath of office to "uphold and defend the Constitution of the United States of America against all enemies, foreign and domestic," if they do not adhere to this oath then they are nothing more than traitors, and do not deserve to be serving our country on any level of government! |

No amendment needed Article VI, Section 2: This Constitution, and the Laws of the United States which shall be made in Pursuance therof: and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land: and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary nothwithstanding. There is nothing in [the Constitution] which intimates that treaties and laws enacted pursuant to [it] do not have to comply with the provisions of the Constitution. Nor is there anything in the debates which accompanied the drafting and ratification of the Constitution which even suggests such a result. These debates as well as the history that surrounds the adoption of the treaty provision in Article VI make it clear that the reason treaties were not limited to those made in "pursuance" of the Constitution was so that agreements made by the United States under the Articles of Confederation, including the important peace treaties which concluded the Revolutionary War, would remain in effect. It would be manifestly contrary to the objectives of those who created the Constitution, as well as those who were responsible for the Bill of Rights—let alone alien to our entire constitutional history and tradition—to construe Article VI as permitting the United States to exercise power under an international agreement without observing constitutional prohibitions. In effect, such construction would permit amendment of that document in a manner not sanctioned by Article V. The prohibitions of the Constitution were designed to apply to all branches of the National Government and they cannot be nullified by the Executive or by the Executive and the Senate combined. - 1957, Justice Hugo Black, writing for Reid v. Covert All three branches of government are already in violation of the Constitution. Explain to me how an additional (unnecessary) amendment would not be violated? |

Why will this matter? Won't our Rep's that desire to do what ever they want just cling onto a warp view of the general welfare clause or the commerce clause? I realize this view is not the original intent of the founders but I don't see where that will make a difference. Point of order? Can't this be done now? I am confused on this one ... |

Just Another Failure From almost the beginning of our constitution, our servants have increasingly ignored portions of that great document when they deem it profitable for them to do so. Why would adding more words to the constitution cause representatives to be anymore obedient than they already are? Why would the foxes limit their treasonous appetites just because the chickens have laws against harmful actions? Two things must be done: Servants must be fully and totally accountable for their actions and their words - including restitution of all which is stolen, and trials and punishment must occur from outside of Congress and from outside of the federal government. |

... Bob, While some congressmen will misconstrue the meaning of the Constitution, this act will remind them of the oath they took to "bear true faith and allegiance" to the Constitution. Perhaps more debate around the real limits of the Constitution would be a good thing. We can thank Sen. Tom Coburn (R-OK) for introducing the act and other senators including Sen. Anyone with that level of typing skill must really know what they are talking about." - Open Sorcerer (or whatever you are today) Having nothing to add to the discussion, but feeling the compulsion to post, you resort to demeaning other people. Your motto should be: "I am become as sounding brass, or a tinkling cymbal." In regards to the Enumerated Powers Act, I would like to see a provision which would also require that all amendments to a bill be germane. Too often, amendments are used to sneak through legislation that has no bearing on the original bill and would have no standing on their own. |
