Choose Freedom — Stop ObamaCare! We’re launching a major new campaign this month, “Choose Freedom — Stop ObamaCare!” We’ll be developing tools for this campaign over the next several months. We didn’t name this campaign simply “Repeal ObamaCare,” because it is broader than that. We’ll be supporting a variety of strategies for stopping ObamaCare, such as: (1) supporting the various state attorneys general in their efforts to have certain provisions of ObamaCare struck down as unconstitutional in federal courts; (2) influencing Congress to defund and repeal ObamaCare in 2011 (ultimate repeal, of course, probably would not occur unless a new president is elected in 2012); and (3) supporting grassroots efforts to persuade state legislatures to nullify ObamaCare on a state-by-state basis. We chose “Choose Freedom” for the first half of our campaign name to emphasize the positive aspect of the campaign. Our goal is to preserve our freedom under the Constitution, not just repeal ObamaCare. For example, if we and other constitutionalists succeed in repealing the Democrats’ ObamaCare only to see it replaced by a Republican ObamaCare-lite, we will have failed. I’ve already heard top Republicans saying, “Repeal and Replace.” The trouble is that many portions of the Republican alternative healthcare reform plans are unconstitutional. So, we must emphasize “Choose Freedom,” to remind ourselves and others that although there are many problems with our current healthcare system, the solutions must not include increasing involvement by the federal government. Instead, the solutions must include decreasing, and ultimately eliminating, involvement by the federal government. We need to improve our healthcare system with initiatives in accordance with the Constitution and our free-market economy. The Nullification Strategy Although we will support initiatives to stop ObamaCare in the courts and in Congress, our primary, initial strategy will be to support the passage of nullification bills in state legislatures. See an article by Joe Wolverton in the May 10 issue of The New American for further information about the growing state resistance to ObamaCare. As you probably already know, nullification is the hot, new strategy for asserting states’ rights under the Tenth Amendment by passing state legislation nullifying specific, unconstitutional federal laws within that state. For example, about 25 states have already introduced a Firearms Freedom Act, which would nullify federal firearms laws within a state for guns manufactured, sold, and used in that state. On April 8, Idaho became the seventh state to pass its Firearms Freedom Act into law, joining Montana, Tennessee, Utah, Wyoming, South Dakota, and Arizona. We’ll be helping our members and like-minded constitutionalists around the nation to get ObamaCare nullification acts introduced and passed in their state legislatures by providing a model “Federal Health Care Nullification Act” for state legislatures as a download at JBS.org. This model act will also be included in the TNA article mentioned above. Restoring Our Freedom Under the Constitution Don’t let others discourage you from working to stop ObamaCare with arguments about how it will be virtually impossible to repeal it. Tell them that if we are to regain our freedom as Americans, we’re going to have to force Congress to repeal a whole lot of unconstitutional laws. With the awakening of millions of Americans to the importance of the Constitution during the past year as evidenced by the amazingly large Tea Party movement and the surprising election victories in several states, we have the opportunity to start this process with the repeal of ObamaCare. Passage of ObamaCare nullification acts in dozens of states would provide the momentum to get this done in Congress. We must be successful in this campaign. Our freedom depends on it! ACTION SUMMARY
